Guideline 38. States should consider, in the case of refusal of extradition only on the basis of nationality, submitting the case, when requested by the State that had sought extradition, to the competent authority in order to consider prosecution.
المبدأ التوجيهي 38 - ينبغي للدول أن تنظر، في حال رفض تسليم المجرمين استنادا إلى جنسيتهم، وعندما تطلب الدولة ملتمسة التسليم ذلك، في عرض القضية على السلطة المختصة لتدرس إمكانية الملاحقة القضائية.

7 - ورحبت وفود عديدة بما أبدته المفوضية من إصرار على تحمّل المسؤولية عن الأشخاص المشردين نتيجة الكوارث الطبيعية في ظل شروط معينة - إذا تبين جلياً أنه لا يوجد أي طرف بديل لتولي المسؤولية وشريطة أن تطلب الدولة المتأثرة المساعدة.
