13. In the light of the above, the Committee is of the view that, in the prevailing circumstances, the State party has an obligation to refrain from forcibly returning Tahir Hussain Khan to Pakistan.

4.8 Reference is made to the case Tahir Hussain Khan v. Canada, where the Committee found that the complainant, if returned to his country of origin which was not a State party to the Convention, would no longer have the possibility of applying to the Committee for protection, unlike the present case where the complainant risks being returned to a country that has acceded to the Convention.
4-8 وأشير إلى الحالة طاهر حسين خان ضد كندا(ج) التي رأت فيها اللجنة أن مقدم الشكوى، إذا أعيد إلى بلد المنشأ، الذي ليس دولة طرفاً في الاتفاقية، لا تتوفر له إمكانية تقديم طلب للحماية إلى اللجنة على خلاف الحالة التي نحن بصددها التي يواجه فيها مقدم الطلب أخطار الإعادة إلى بلد انضم إلى الاتفاقية(د).
