The prison doctor testified that when Mr. Sahadeo was admitted, he complained that he had been beaten on the back.

On 26 May 1994, Mr. Sahadeo and his co-accused were again convicted and sentenced to death.

Mr. Sahadeo claimed that during police investigation in 1985 he was beaten by three policemen and that one policeman hit him on the toe with a small hammer.

The Committee observes that Mr. Sahadeo's allegations of torture had been dealt with during the first trial in 1989 and again in the retrial in 1994.

2.2 The author states that Mr. Sahadeo and his co-accused were convicted and sentenced to death on 8 November 1989, four years and two months after their arrest.

2.6 In a statement from the dock, Mr. Sahadeo denied having anything to do with the murder and stated that he had been beaten in order to force him to sign the confession on the third day after his arrest.

5. By note of 30 June 1998, the State party informed the Committee that it had no objection to admissibility, as Mr. Sahadeo had exhausted all available domestic remedies.
5- وبمذكرة مؤرخة 30 حزيران/يونيه 1998، أحاطت الدولة الطرف اللجنة علماً بأن ليس لديها أي اعتراض على مقبولية البلاغ لأن السيد سهاديو قد استنفد جميع سبل الانتصاف الداخلية المتاحة.

9.3 With regard to the circumstances in which the confession was signed, the Committee notes that Mr. Sahadeo identified those he holds responsible; further details of his allegations appear from the notes of evidence.
