3.6 The Lakhdar-Chaouch family has never ceased to contact the Algerian authorities in order to ascertain what has become of their son since his disappearance.

In the present case, the Committee notes that the authorities of the State party have not provided the author with any information on the fate or whereabouts of Ali Lakhdar-Chaouch despite the author's requests to various State party authorities.

2.3 On 12 February 2001, the author appealed the ruling on behalf of the Lakhdar-Chaouch family on the grounds that those responsible for the arrest could be identified and that the hospital director could be called on to testify.
2-3 وفي 12 شباط/فبراير 2001، طعنت صاحبة البلاغ في هذا القرار باسم أسرة لخضر شاوش على أساس أن المسؤولين عن التوقيف يمكن التعرف عليهم وأن مديرة المستشفى يمكن استدعاؤها للشهادة.

Concerning the State party's contention that domestic remedies have not been exhausted, the author recalls that the Lakhdar-Chaouch family, in accordance with Algerian legal procedure, submitted numerous appeals, all of which proved ineffective.
وبالنظر إلى دفع الدولة الطرف الرامي إلى الطعن في استنفاد سبل الانتصاف الداخلية، تذكر صاحبة البلاغ بأن أسرة لخضر شاوش التمست العديد من سبل الانتصاف، احتراماً للإجراءات الجزائرية، غير أن أياً منها لم يجد نفعاً.

The Committee notes that, in the present case, Ali Lakhdar-Chaouch was arrested by Algerian military security officers on 1 April 1997 and that he has had no contact with his family since then.
وفي هذه الحالة، تلاحظ اللجنة أن الشرطة ألقت القبض على علي لخضر شاوش في 1 نيسان/أبريل 1997 وانقطع كل اتصال بينه وبين أسرته منذ ذلك الحين.

In the absence of satisfactory explanations from the State party, the Committee finds a violation of article 9 in respect of Ali Lakhdar-Chaouch.
وفي غياب أي توضيحات مقنعة من الدولة الطرف، تخلص اللجنة وقوع انتهاك للمادة 9 في حق علي لخضر شاوش().

The Committee concludes that Ali Lakhdar-Chaouch's enforced disappearance since 1 April 1997 has denied him the protection of the law and deprived him of his right to recognition as a person before the law, in violation of article 16 of the Covenant.
وتخلص اللجنة إلى أن اختفاء علي لخضر شاوش قسراً منذ 1 نيسان/أبريل 1997حرمه من حماية القانون وحرمه من حقه في أن يُعترف له بشخصيته القانونية، وفي ذلك انتهاك للمادة 16 من العهد.
