This is a widespread problem, involving a practice which not only is inconsistent with conclusions and recommendations of the Executive Committee, but, in some cases, is aggravated by unacceptable conditions of detention.

Article 19. Detention conditions of an alien subject to expulsion
المادة 19 - شروط احتجاز الأجنبي الخاضع للطرد

The first concerned the title of the draft article which, in the view of those States, should be: " Detention of an alien subject to expulsion " rather than " Detention conditions of an alien subject to expulsion " .
فالاقتراح الأول يتعلق بعنوان مشروع المادة الذي ترى أنه ينبغي أن يكون كالتالي: ' ' احتجاز الأجنبي الخاضع للطرد`` بدل ' ' شروط احتجاز الأجنبي الخاضع للطرد``.

24. JS1 reported that Detention conditions of irregular migrants were in violation of international standard as access to recreational activities, proper hygienic conditions, and regular access to health care and psycho-social assistance were not provided.

7 - المادة 19 - شروط احتجاز الأجنبي الخاضع للطرد .

Draft article 19, paragraph 1 (b), prescribes the Detention conditions of an alien subject to expulsion.
تقرّر الفقرة 1 (ب) من مشروع المادة 19 شروط احتجاز أجنبي خاضع للطرد.

" (vi) To stop mass arrests and arbitrary detentions; to release all administrative detainees, including those detainees who have not committed serious crimes, such as murder; to guarantee those arrested Detention conditions in accordance with the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment of Punishment and with the Fourth Geneva Convention;

61. His delegation proposed that draft article 19 (Detention conditions of an alien subject to expulsion) should be split into two separate draft articles, one dealing with detention and the other with Detention conditions.
61 - وأضاف أن وفده يقترح ضرورة تقسيم مشروع المادة 19 (شروط احتجاز الأجنبي الخاضع للطرد) إلى مشروعي مادتين منفصلين، أحدهما يتناول الاحتجاز والآخر يتناول شروط الاحتجاز.

13. Another issue raised by NGOs on several occasions are the allegations regarding the conditions of detention of people arrested by the occupying Powers mainly in connection with security crimes or terrorist acts, and whose whereabouts were not known to their families.
13- وثمة قضية أخرى أثارتها المنظمات غير الحكومية في أكثر من مرة وهي الادعاءات بشأن شروط احتجاز الأشخاص الذين تعتقلهم قوات الاحتلال بالدرجة الأولى فيما يتعلق بجرائم الأمن أو الأعمال الإرهابية، والذين لا تعرف أسرهم أماكن وجودهم.

62. A new draft article 19 bis, entitled " conditions of detention of aliens subject to expulsion " should be added, to read as follows:
62 - وقال إنه ينبغي إضافة مشروع مادة جديدة هي 19 مكررا، بعنوان " شروط احتجاز الأجانب الخاضعين للطرد " ، وفي ما يلي نصها:

(b) Take urgent steps to substantially improve the conditions of detention of persons below 18 when deprived of their liberty, in conformity with international standards;
(ب) اتخاذ خطوات عاجلة لإدخال تحسينات هامة على شروط احتجاز من تقل أعمارهم عن 18 سنة وجعلها متطابقة بالكامل مع المعايير الدولية؛

(d) Take urgent steps to improve substantially the conditions of detention of persons below 18 and bring them into full conformity with international standards;
(د) أن تتخذ خطوات عاجلة لإدخال تحسينات هامة على شروط احتجاز من تقل أعمارهم عن 18 سنة وجعلها متطابقة بالكامل مع المعايير الدولية؛

(b) Take urgent steps to substantially improve the conditions of detention of persons below 18 when deprived of their liberty in conformity with international standards;
(ب) اتخاذ خطوات عاجلة لإدخال تحسينات هامة على شروط احتجاز من تقل أعمارهم عن 18 سنة وجعلها متطابقة بالكامل مع المعايير الدولية؛

52. The same community of States proposed the addition of a draft article 19 bis, entitled " conditions of detention of aliens subject to expulsion " , setting out a series of rights which the alien subject to expulsion should enjoy.
52 - وتقترح نفس الجماعة من الدول إدراج مشروع مادة 19 مكررا يكون عنوانها كالتالي: ' ' شروط احتجاز الأجنبي الخاضع للطرد``()، وتورد تفاصيل مجموعة من الحقوق التي يتعين أن يتمتع بها الأجنبي الخاضع للطرد.
