The Panel finds that a direct loss is one which, as a matter of objective assessment, would have been expected as a normal and natural consequence of Iraq's invasion and occupation of Kuwait. /
28- ويرى الفريق أن الخسارة المباشرة هي الخسارة التي يمكن من ناحية التقييم الموضوعي تصور وقوعها كنتيجة عادية وطبيعية لغزو العراق واحتلاله للكويت(16).

The Panel found that there is ample authority in international law, including the reports of other panels,[viii] to support the view that a “direct loss” in these circumstances is one which, as a matter of objective assessment, would have been expected as a normal and natural consequence of Iraq’s invasion and occupation of Kuwait.
23- ويرى الفريق أنه توجد السند الكافي في القانون الدولي، وكذلك في تقارير أفرقة أخرى(8) لدعم الرأي القائل إن " الخسارة المباشرة " في هذه الظروف هي الخسارة التي يمكن من ناحية التقييم الموضوعي تصور وقوعها كنتيجة عادية وطبيعية لغزو العراق للكويت واحتلاله لها.

The use or diversion of Kuwait’s resources to fund the costs of putting right loss and damage arising directly from Iraq’s invasion and occupation of Kuwait is to be regarded as a “normal and natural” consequence of that invasion and occupation; and

In the circumstances, the Panel finds that the Order would have been expected as a normal and natural consequence of Iraq’s invasion and occupation of Kuwait, except to the extent that it forgave industrial plot rental in respect of tenants that occupied premises during the period from 1 July to 1 August 1990, or the emergency period, for which the Panel has made a further adjustment.

Kuwait further argued that the losses were direct losses because it was a normal and natural consequence of the annexation of Kuwait by Iraq and would lead to “Kuwait’s repayment rights … becoming [unavailable to KIA]”.
534- وذكرت الكويت أيضاً أن الخسائر كانت خسائر مباشرة لأنها كانت نتيجة عادية وطبيعية لضمّ العراق للكويت وأنها ستجعل " حقوق الكويت في استرجاع المبالغ ... تصبح [غير متاحة للهيئة الكويتية العامة للاستثمار] " .

For those claims found to be compensable in principle, the Panel has considered whether the passing and effect of the decree(s) or law(s) concerned [xv]/ comprised a response to Iraq’s invasion and occupation of Kuwait that, as a matter of objective assessment, would have been expected as a normal and natural consequence of Iraq’s invasion and occupation of Kuwait.
21- وفيما يتعلق بالمطالبات التي اعتبرت قابلة للتعويض من حيث المبدأ، نظر الفريق فيما إذا كان إصدار وتنفيذ المرسوم (المراسيم) أو القانون (القوانين) المعني (المعنية)(11) يمثلان رداً على غزو العراق واحتلاله للكويت، كان يمكن توقعه، عند إجراء تقييم موضوعي، كنتيجة عادية وطبيعية لغزو العراق واحتلاله للكويت.

In the circumstances, the Panel finds that the Order would have been expected as a normal and natural consequence of Iraq’s invasion and occupation of Kuwait, except to the extent that it forgave rent: (a) for the month of July 1990 (i.e. before Iraq’s invasion and occupation of Kuwait); (b) for the month of June 1991 (i.e. after the emergency period); and (c) in respect of tenants who reoccupied premises during the emergency period.
