The Committee will also declare a communication inadmissible if it considers it to be an abuse of the right to petition.

The State party therefore considers that the communication should be declared inadmissible, since domestic remedies have not been exhausted.

6.1 Before considering any claims contained in a communication, the Human Rights Committee must, in accordance with rule 91 of the rules of procedure, decide whether or not it is admissible under the Optional Protocol to the Covenant.
