Under the legal system of the Republic of Yemen, anyone who is subjected to any act of torture has the right to apply to the courts in order to seek legal redress.
165- ضَمِن النظام القانوني في الجمهورية اليمنية لمن يتعرض لأي عمل من أعمال التعذيب الحق في اللجوء إلى القضاء لإنصافه.

(ج) الحرص على قيام السلطات المختصة بالعمل فوراً على إجراء تحقيق محايد كلما توفرت دوافع معقولة للاعتقاد باحتمال ارتكاب عمل من أعمال التعذيب.

(12) The Committee is concerned at the judiciary's de facto dependence on the executive, which poses a major obstacle to the immediate institution of an impartial inquiry when there are substantial grounds for believing that an act of torture has been committed in any territory under its jurisdiction.
(12) وتشعر اللجنة بالقلق إزاء تبعية السلطة القضائية تبعيةً فعلية للسلطة التنفيذية، وهو ما يشكّل عائقاً كبيراً أمام بدء تحقيق فوري ونزيه عندما تتوفر أسباب معقولة تدعو إلى الاعتقاد بارتكاب عمل من أعمال التعذيب داخل إقليم يخضع لولاية الدولة الطرف.

Moreover, if an act of torture led to the victim's death, it might be considered as murder, which carried the maximum penalty of life imprisonment.
وعلاوة على ذلك، إذا أدى أي عمل من أعمال التعذيب الى وفاة الضحية، فيمكن أن يعتبر جريمة قتل متعمدة يعاقب عليها بعقوبة أقصاها السجن مدى الحياة.

As requested by the Committee against Torture, when an investigating authority was accused of an act of torture or implicated in an accident, investigators would be brought in from outside.
ويُستعان بمحققين من الخارج، كما طلبت لجنة مناهضة التعذيب، عندما تُتهم سلطة تحقيق بارتكاب عمل من أعمال التعذيب أو بالتورط في حادثة.
