وفي حين أن هناك حاجة إلى تأصيل اﻷساس القانوني الدقيق لتلك التدابير في نص كل من المعاهدات ذات الصلة، فإنه يمكن العثور على القاعدة الرئيسية في نهج غائي للتفسير يسلم بسخف أي نتيجة أخرى إذ أنها تمكﱢن الدولة الطرف المتخلفة عن موعدها من إفشال غاية أحكام التنفيذ ومقاصدها.

This precept is an expression of the normative force of the Constitution and is to be understood as a regulatory principle which requires judges to adopt a teleological approach to interpreting constitutional provisions in order to ensure an interpretation consistent with the principles and purposes of a social and democratic State governed by the rule of law.
ويعبر هذا المبدأ عن القوة المعيارية للدستور ويجب أن يفهم كمبدأ تنظيمي يتطلب من القضاة اعتماد نهج غائي في تفسير النصوص الدستورية من أجل ضمان وجود تفسير متسق مع مبادئ ومقاصد دولة اجتماعية وديمقراطية تحكمها سيادة القانون.
