(k) " procurement regulations " means regulations enacted in accordance with article 4 of this Law;

Article 4. procurement regulations
المادة 4- لوائح الاشتراء التنظيمية

The [name of the organ or authority authorized to promulgate the procurement regulations] is authorized to promulgate procurement regulations to fulfil the objectives and to implement the provisions of this Law.
يُؤذَن لـ[يُدرج هنا اسم الهيئة أو السلطة المفوّضة بإصدار لوائح الاشتراء التنظيمية] بأن تصدر لوائح تنظيمية للاشتراء من أجل تحقيق أهداف هذا القانون وتنفيذ أحكامه.

(b) A margin of preference for the benefit of domestic suppliers or contractors or domestically produced goods, if authorized or required by the procurement regulations or other provisions of law of this State.
(ب) هامش تفضيل لصالح المورِّدين أو المقاولين المحليين، أو لصالح السلع المنتَجة محلياً، إذا كانت لوائح الاشتراء التنظيمية أو غيرها من الأحكام في قانون هذه الدولة تأذن بذلك أو تشترطه.

(3) The procurement regulations shall provide for the manner of publication of the notices required under this article.
(3) يجب أن تنص لوائح الاشتراء التنظيمية على كيفية نشر الإشعارات التي تقتضيها هذه المادة.

(w) Other information required to be included in the record in accordance with the provisions of this Law or the procurement regulations.
(ث) أيَّ معلومات أخرى يلزم إدراجها في السجل بمقتضى أحكام هذا القانون أو لوائح الاشتراء التنظيمية.

(vii) Reference to this Law, the procurement regulations and other laws and regulations directly pertinent to the procurement proceedings, including those applicable to procurement involving classified information, and the place where these laws and regulations may be found;

The purpose of article 4 is to highlight the need for procurement regulations to fulfil the objectives and to implement provisions of the Model Law.

Reference to the " procurement regulations " should be interpreted in accordance with the legal traditions of the enacting State; the notion may encompass any tool used in the enacting State to implement its statutes.
2- والإشارة إلى " لوائح الاشتراء التنظيمية " ينبغي أن تُفسَّر وفقا للأعراف القانونية للدولة المشرعة؛ وقد تشمل أيّ أداة تُستخدم في الدولة المشترعة لتنفيذ قوانينها التشريعية.

Procurement of readily available goods or services that are not specially produced or provided to the particular description of the procuring entity and for which there is an established market, so long as the estimated value of the procurement contract is less than the threshold amount set out in the procurement regulations
عند اشتراء سلع أو خدمات متاحة بيسر، لا تنتَج أو توفَّر خصيصا حسب الوصف الخاص المقدَّم من الجهة المشترية، ولها سوق راسخة الأسس، ما دامت القيمة المقدّرة لعقد الاشتراء تقلّ عن مقدار العتبة المحدّدة في لوائح الاشتراء التنظيمية

It was the understanding that the procurement regulations might fix different minimums for different types of procurement and that the Model Law would require the procurement regulations to address the standstill period(s).
وجرى التفاهم على جواز أن تضع تلك اللوائح حدودا دنيا مختلفة باختلاف أنواع الاشتراء؛ وعلى أن يشترط القانون النموذجي أن تعالج لوائح الاشتراء التنظيمية فترة (فترات) التوقف.

" (2) Paragraph (1) is not applicable to awards where the contract price is less than the threshold amount set out in the procurement regulations. "

Whereas paragraph (1) refers to a restriction on the ground of nationality, paragraph (2) is open-ended as regards the nature of the grounds that may be found in the procurement regulations or other provisions of law of the enacting State.
وبينما تشير الفقرة (1) إلى تقييد بسبب الجنسية، فإنَّ المادة (2) لا تضع حدودا لطبيعة الأسباب التي قد توجد في لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة.

For these reasons, these criteria should be treated as exceptional, as recognized by the requirement that their application be subject to a distinct requirement -- that they must be authorized or required for application under the procurement regulations or other provisions of law of the enacting State.
ولهذه الأسباب، يجب أن تُعامل تلك المعايير باعتبارها استثنائية، كما يتبيّن من شرط إخضاع تطبيقها لاشتراط منفصل - يجب التخويل بها أو طلبها من أجل التطبيق بموجب لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة.
