The demand for provision of assistance to national prosecuting authorities in respect of cases being investigated or prosecuted by them also continued to grow.

They shall be disqualified from a case in accordance with this paragraph if, inter alia, they have previously been involved in any capacity in that case before the Court or in a related criminal case at the national level involving the person being investigated or prosecuted.

Amendments to the Rules of Procedure and Evidence as well as provisional Rules shall not be applied retroactively to the detriment of the person who is being investigated or prosecuted or who has been convicted.

باء - ينحى القاضي متى صدر طلب بتنحيته من المدعي العام أو الشخص محل التحقيق أو المقاضاة أو من الضحايا أنفسهم.

ويُنحّى القاضي عن أية قضية وفقا لهذه الفقرة إذا كان قد سبق له، ضمن أمور أخرى، الاشتراك بأية صفة في تلك القضية أثناء عرضها على المحكمة أو في قضية جنائية متصلة بها على الصعيد الوطني تتعلق بالشخص محل التحقيق أو المقاضاة.

(b) The Prosecutor or the person being investigated or prosecuted may request the disqualification of a judge under this paragraph.

The defence additionally filed an appeal directly to the Appeals Chamber on the basis of article 82.1 (b) of the Rome Statute, which provides for appeal of a " decision granting or denying release of the person being investigated or prosecuted " .
