89. The Special Rapporteur had given a broad provisional interpretation of the term " expulsion " , which was in line with the concept of expulsion as defined by the Human Rights Committee in its general comment No. 15 concerning the position of aliens under the Covenant.

In this connection, the Committee reiterates its view, as expressed in its general comment 20 (44), that this type of amnesty is incompatible with the duty of States to investigate human rights violations, to guarantee freedom from such acts within their jurisdiction, and to ensure that they do not occur in the future.

71. In order to stress the temporary nature of the state of emergency, the Human Rights Committee stated its understanding, in its general comment 5 on article 4 of the Covenant, that the obligation to inform the other States parties immediately of the rights suspended included the reasons therefor and the date on which the suspension would end.
١٧- وأكدت اللجنة المعنية بحقوق اﻹنسان على الطابع المؤقت لحالة الطوارئ فأعربت، في ملاحظتها العامة رقم ٥ التي أبدتها بشأن المادة ٤ من العهد، عن اعتقادها بأن الالتزام بإبلاغ الدول اﻷطراف اﻷخرى في الحال بالحقوق التي جرى تعليقها إنما يشمل بيان اﻷسباب الباعثة على ذلك والتاريخ الذي سينتهي فيه التعليق.

(e) Human Rights Committee. The Committee could expand its general comment on the right to life in order to include environmental concerns or formulate a general comment defining the links existing between civil and political rights and the environment.
