It was noted that consumers might seek help in accessing an ODR online platform and presenting their case, perhaps from domestic consumer organizations -- whose personnel may or may not be lawyers -- or from an ODR provider in their own country, including assisting them to overcome any language difficulties in accessing an ODR online platform.

5. If settlement is reached during the negotiation stage, the terms of such settlement shall be recorded on the ODR platform, at which point, the ODR proceedings will automatically terminate.
5- إذا تمّ التوصّل إلى تسوية أثناء مرحلة التفاوض سُجِّلت شروطُ تلك التسوية في منصة التسوية الحاسوبية وانتهت عندئذ إجراءات تسوية المنازعات بالاتصال الحاسوبي المباشر تلقائياً.

3. If the parties reach a settlement, such settlement shall be recorded on the ODR platform, at which point, subject to article 7, paragraph (5), the ODR proceedings will automatically terminate.

Moreover, it was said that in practice the terms " ODR platform " and " ODR provider " were not used in the online dispute resolution field and that it was difficult to provide a clear and distinct definition for those terms.

A suggestion was made to replace paragraph (6) as follows: " the ODR administrator shall promptly notify a party or the neutral of the availability of any communication directed to that party or the neutral at the ODR platform. "
67- اقتُرحت الاستعاضةُ عن الفقرة 6 بما يلي: " يسارع مدير خدمة التسوية الحاسوبية إلى تبليغ الطرف المعني أو المحايد بوجود أيِّ خطاب مُوجَّه إلى ذلك الطرف أو إلى المحايد في منصة التسوية الحاسوبية " .

It was said that both the ODR platform and the ODR administrator ought to be specified in the dispute resolution clause for purposes of transparency and accountability.
134- وقيل إنه يجدر تحديد كل من منصة التسوية الحاسوبية ومدير خدمة التسوية الحاسوبية في بند تسوية المنازعات بغرض الشفافية والمساءلة.

After discussion, it was agreed that draft article 12 would read as follows: " The ODR platform and ODR administrator shall be specified in the dispute resolution clause. "
وأجري نقاشٌ اتُّفق بعده على أن تكون صيغة مشروع المادة 12 على النحو التالي: " يُحدَّد في بند تسوية المنازعات كلٌّ من منصة التسوية الحاسوبية ومدير خدمة التسوية الحاسوبية. "

In response, it was noted that the overwhelming majority of claims were settled before the end of a facilitated negotiation stage, and so the proposal in its current form would reduce the burden on both the ODR administrator and on the parties.
