The penalty for any of the offences under this Act shall not exceed imprisonment for a term of 15 years, a fine of BND $10,000 and 12 strokes of whipping.

None of the offences set forth in article 1 bis shall be regarded, for the purposes of extradition or mutual legal assistance, as a political offence or as an offence connected with a political offence or as an offence inspired by political motives.

2. With respect to superior and subordinate relationships, a superior shall be criminally responsible for any of the crimes set forth in article 2 of this Statute committed by subordinates under his or her effective authority and control, as a result of his or her failure to exercise control properly over such subordinates, where:

(3) Where, in committing any of the offences under paragraph 1 of the present article, the perpetrator killed with wrongful intent one or more persons, he or she shall be sentenced to a prison term no shorter than 10 years or to a 40-year prison term.

In that connection the text of article 3, paragraph 3, could be amended to read: " An individual who attempts to commit one of the crimes set out in this Code is responsible therefore and is liable to punishment.

Article 13 provides that a death sentence may not be commuted to life imprisonment, nor may a life sentence be commuted to one of a fixed-term of imprisonment, save as otherwise provided in article 83 of the Criminal Code. According to article 13, the courts may not order a stay of execution of sentence or withhold sentence in respect of offences under the Act.

However, the view was expressed that that Convention, which was not yet in force, dealt with offences that did not have the same degree of seriousness as those categories of crimes provided for in the draft.

Paragraph 4 of the article provides that all the perpetrators of any of the offences set out in international treaties are criminally liable, whatever form their participation takes.

If an offender is convicted on more than two occasions of any of the offences specified in the Act, he permanently forfeits the right to hold a licence to drive motor vehicles.
