After the search of his house, he was moved to a municipal jail at 237 Nguyen Van Cu Street, District 1, Ho Chi Minh City, where he remains to this day.
ونُقل بعد تفتيش بيته إلى سجن محلي يقع في 237 شارع نغويين فان كو، بالحي رقم 1، في مدينة هو شي مين حيث لا يزال محتجزاً حتى الآن.

14. According to the Government, Nguyen Van Ly is a recidivist.

The source concluded that the Government detained Nguyen Van Ly in connection with the peaceful expression of his beliefs and has failed to afford him the procedural protections guaranteed by domestic law and international treaties.

17. The Government has not presented convincing arguments to invalidate the allegations from the source, who argues that Nguyen Van Ly was sentenced to 13 years of detention because he had published articles critical of the Government and of the Communist Party and his trial had not respected international norms.
17- ولم تقدم الحكومة حججاً مقنعة لتخطئة مزاعم المصدر الذي يؤكد أن نغويين فان لي حكم عليه بالسجن 13 عاماً بسبب نشره مقالات تنتقد الحكومة والحزب الشيوعي وأن المحاكمة لم تتقيد بالمعايير الدولية.

For this reason, the Working Group is convinced that Thadeus Nguyen Van Ly has been arrested and detained only for his opinions, in violation of article 19 of the Universal Declaration of Human Rights and of article 19 of the International Covenant on Civil and Political Rights, to which Viet Nam is a party.

The deprivation of liberty of Father Thadeus Nguyen Van Ly is arbitrary, being in contravention of article 19 of the Universal Declaration of Human Rights and article 19 of the International Covenant on Civil and Political Rights, and falls within category II of the categories applicable to the consideration of the cases submitted to the Working Group.

Another eight persons, Mr. Francis Xavier Duan Xuan Dieu; Mr. Peter Ho Duc Hoa; Mr. John the Baptist Nguyen Van Oai; Mr. Hung Anh Nong; Mr. John the Baptist Van Duyet; Mr. Paul Ho Van Oanh; Mr. John Thai Van Dung and Mr. Paul Tran Minh Nhat, were arrested on the basis of their alleged involvement in the Viet Tan Party.

In addition seven requests for legal representation were rejected, from Mr. Francis Xavier Dang Xuan Dieu; Mr. Peter Ho Duc Hoa; Mr. John the Baptist Nguyen Van Oai; Mr. Paulus Le Van Son; Mr. John the Baptist Van Duyet; Mr. Peter Nguyen Xuan Anh and Mr. John Thai Van Dung.

13. In its reply, the Government stated that it is totally untrue that Nguyen Van Ly's detention and sentence are a punishment for peacefully exercising his rights and freedoms, that in Viet Nam no one shall be detained or punished for exercising his legal rights and freedoms, and that only those who are charged with having violated the law shall be tried, in strict compliance with the law.
13- وقالت الحكومة في ردها إنه غير صحيح على الإطلاق أن يكون احتجاز نغويين فان لي وإدانته عقاباً على ممارسته حقوقه وحرياته سلمياً وإنه في فييت نام لا يجوز احتجاز أي شخص أو معاقبته على ممارسته حقوقه وحرياته القانونية وإن من يُتهمون بانتهاك القانون هم وحدهم الذين يحاكمون، بالامتثال التام للقانون.

18. Consequently, the Working Group is led to conclude that Father Nguyen Van Ly was arrested and sentenced to prison for having peacefully exercised his right to freedom of opinion and expression guaranteed in article 19 of the Universal Declaration of Human Rights and article 19 of the International Covenant on Civil and Political Rights.
