39- أما الفئة الثالثة فتنطبق عندما يكون عدم التقيد الكلي أو الجزئي بالمعايير الكلية المتعلقة بالحق في محاكمة عادلة، وهي المعايير المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الولايات المتحدة، جسيماً على نحو يُضفي على الحرمان من الحرية طابعاً تعسفياً.

25. The Working Group will not consider proven the allegation that the detention is arbitrary owing to the serious total or partial non-observance of the international norms relating to the right to a fair trial, as established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the State concerned.

III. 11. The Working Group's mandate requires it to investigate cases of deprivation of liberty imposed arbitrarily, provided that no final decision has been taken in such cases by domestic courts in conformity with domestic law, with the relevant international standards set forth in the Universal Declaration of Human Rights and with the relevant international instruments accepted by the States concerned.
11- وتقضي ولاية الفريق العامل بأن يحقق الفريق في حالات الحرمان التعسفي من الحرية، شريطة ألاَّ تكون المحاكم المحلية قد اعتمدت قراراً نهائياً وفقاً للقانون المحلي والمعايير الدولية ذات الصلة المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي وافقت عليها الدول المعنية.

1. The Working Group on Arbitrary Detention was established by the former Commission on Human Rights in its resolution 1991/42 and entrusted with the investigation of instances of alleged arbitrary deprivation of liberty, according to the standards set forth in the Universal Declaration of Human Rights and the relevant international instruments accepted by the States concerned.
1- أنشأت لجنة حقوق الإنسان الفريق العامل المعني بالاحتجاز التعسفي بموجب قرارها 1991/42، وعهدت إليه بالتحقيق في حالات ادعاء الحرمان التعسفي من الحرية وفقاً للمعايير المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية.
