ويحق لكل شخص، عند البت في أي اتهام جنائي موجه ضده أو في حقوقه والتزاماته في أي قضية أمام المحاكم، أن يحصل على محاكمة عادلة وعلنية أمام محكمة مختصة ومستقلة ومحايدة منشأة بحكم القانون.

Criminal trials are assessed against fair trial guarantees laid down in human rights law, including the right to a public hearing by a competent, independent and impartial tribunal established by law and a presumption of innocence, the right to counsel, equality of arms and the right to appeal.

From that point of view, the essence of article 14 became a nonderogable and absolute issue; namely that part of the article relating to the right to a fair and public hearing by a competent, independent and impartial tribunal established by law and the right to be presumed innocent.
ومن هـذا المنطلق، أصبحت ماهيّة المادة 14 غير قابلة للتقييد وتشكل قضية جوهرية، أي ذلك الجزء من المادة المتعلق بالحق في محاكمة عادلة وعلنية أمام محكمة مختصة ومحايدة منشأة بموجب القانون والـحق في افتراض البراءة.

54. Article 4 of the Law on Criminal Procedure states the following: Everyone charged with a criminal offence shall have the right to a fair and public hearing within a reasonable time and before a competent, independent and impartial tribunal, established by law.

Everyone shall have the right to a public hearing before an independent and impartial tribunal established by the law within reasonable time which shall pronounce judgement on their rights and obligations, grounds for suspicion resulting in initiated procedure and charges brought against them.
76- ولكل شخص الحق في محاكمة علنية أمام محكمة مستقلة ومحايدة منشأة بموجب القانون في غضون مدة زمنية معقولة، وتنظر المحكمة في حقوقه الشخص والتزاماته، وأسباب الاشتباه التي تؤدّي إلى تحريك الدعوى وتوجيه التهم له وتصدر حكمها على هذا الأساس.

The Charter of the United Nations, the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights enshrine the principles of equality before the law, the presumption of innocence and the right to a fair and public hearing without undue delay by a competent, independent and impartial tribunal established by law.
