وفي حال إقامة الدعوى، ترفع جرائم الاختفاء القسري إلى محكمة مختصة ومستقلة ونزيهة ينشئها القانون.

وتنص المادة ٩٩ من الدستور على ان الالتزام بمعايير العمل والسلامة والنظافة في العمل يجب أن يخضع ﻹشراف السلطات التي ينشئها القانون والتي تحدد بدورها العقوبات على أي انتهاك يحدث.

٨٥١- وتمثلت أهم اﻹصلاحات فيما يلي: " تمارَس السلطة القضائية من جانب محكمة العدل العليا في البلد، والمحكمة الدستورية، والمحاكم العالية للدوائر، والمحاكم العادية والقضاه، وأي محاكم أخرى ينشئها القانون.

101. The most important reforms are as follows: " Judicial authority is exercised by the Supreme Court of Justice, the Constitutional Court, the higher district courts, the trial courts and judges, and any other courts or tribunals that may be established by law.
101- وتمثلت أهم الإصلاحات فيما يلي: " تمارَس السلطة القضائية من قِبَل محكمة العدل العليا في البلد، والمحكمة الدستورية، والمحاكم العالية للدوائر، والمحاكم العادية وقضاة محاكم أول درجة، وأي محاكم أخرى ينشئها القانون.

(j) " Informal justice system " refers to the resolution of disputes and the regulation of conduct by adjudication or with the assistance of a neutral third party that is not part of the judiciary as established by law and/or whose substantive, procedural or structural foundation is not primarily based on statutory law;
(ي) يشير تعبير " نظام العدالة غير الرسمي " إلى تسوية النـزاعات وتنظيم السلوك بقرار يصدره، أو مساعدة يقدمها، طرف ثالث محايد ليس جزءا من المنظومة القضائية التي ينشئها القانون و/أو لا تستند أسسه الجوهرية أو الإجرائية أو الهيكلية إلى القانون التشريعي في المقام الأول؛

(j) " Informal justice system " refers to the resolution of disputes and the regulation of conduct by adjudication or with the assistance of a neutral third party that is not part of the judiciary as established by law and/or whose substantive, procedural or structural foundation is not primarily based on statutory law;
(ي) يشير تعبير ˮنظام العدالة غير الرسمي " إلى تسوية النـزاعات وتنظيم السلوك بقرار يصدره، أو مساعدة يقدمها، طرف ثالث محايد ليس جزءا من المنظومة القضائية التي ينشئها القانون و/أو لا تستند أسسه الجوهرية أو الإجرائية أو الهيكلية إلى القانون التشريعي في المقام الأول؛

(d) To ensure that safe child- and gender-sensitive procedures and complaint, reporting and counselling mechanisms are established by law, are in conformity with international human rights instruments and are accessible to all children and their representative or a third party without fear of reprisal or discrimination;
(د) ضمان وجود إجراءات وآليات شكوى وإبلاغ وإرشاد مأمونة مراعية لاحتياجات الطفل وللمتطلبات الجنسانية ينشئها القانون وتكون متوافقة مع الصكوك الدولية لحقوق الإنسان ويمكن أن يصل إليها كلُّ الأطفال وممثلوهم أو طرف ثالث دون خوف من الانتقام منهم ودون تمييز؛
