KHR reports that an eminent jurist in Algeria, who had been appointed by the President of the Republic to conduct an inquiry into the events in Kabylia in 2001, concluded that the arrangements currently in place give sweeping powers to the military authorities so that the state of emergency is sliding towards a fullscale state of siege.
وتلاحظ المنظمة أن أحد رجال القانون المرموقين في الجزائر، كان قد فوضه رئيس الجمهورية لقيادة تحقيق بشأن الأحداث التي شهدتها منطقة القبائل في عام 2001، لاحظ أن الإجراءات القائمة تتيح للسلطات العسكرية صلاحيات فائقة وأنها تشكل انزلاقاً من حالة الطوارئ إلى حالة حصار حقيقي().

CMA recommends, in particular, to the members of the Human Rights Council that they call on the Algerian Government to take legislative and administrative steps to bring to justice and punish the perpetrators and instigators of crimes committed in Kabylia in spring 2001, and to ensure adequate medical, psychological and social care for persons who were seriously wounded by gendarme gunfire in the same region in 2001/2002.
ويوصي المؤتمر بصفة خاصة أعضاء مجلس حقوق الإنسان بأن يطلبوا إلى الحكومة الجزائرية أن تتخذ تدابير تشريعية وإدارية لمحاكمة ومعاقبة مرتكبي الجرائم التي شهدتها منطقة القبائل في ربيع عام 2001 والمسؤولين عنها، وأن تكفل الرعايةَ الطبية والنفسانية والاجتماعية المناسبة للأشخاص الذين تعرضوا لإصابات بالغة الخطورة من جراء إطلاق رجال الدرك النار في عامي 2001/2002 في تلك المنطقة().
