Such decisions often invoke choice of law principles to determine the applicable national law, and they frequently cite the directive in article 7 (2) that issues within the scope of the CISG which are settled neither by its express provisions nor by the general principles on which it is based should be determined " in conformity with the law applicable by virtue of the rules of private international law " .

In those cases in which the Convention's application is excluded with an indication of the applicable law, which in some countries can be made in the course of the legal proceedings, the law applicable will be that applicable by virtue of the rules of private international law of the forum, which in most countries makes applicable the law chosen by the parties.
وفي الحالات التي يتمّ فيها استبعاد تطبيق الاتفاقيّة مع بيان القانون المنطبق، وهو ما يمكن عمله في بعض البلدان في سياق المداولات القانونيّة8، يكون القانون المطبّق هو ذلك المطبّق بحكم قواعد القانون الدوليّ الخاصّ للهيئة القضائيّة9، وهي التي تطبّق في معظم البلدان القانون الذي يختاره الطرفين10.

Since the amount of interest rate is not expressly settled in the CISG, the Court referred to article 7 (2) of the Convention according to which questions on matters not expressly settled in the CISG are to be settled in conformity with the law applicable by virtue of the rules of private international law.

The Court held that, although article 78 of CISG did not establish a dies a quo for arrears to be paid, article 7.2 provided that questions that were not expressly settled in the Convention were to be settled in conformity with the general principles on which it was based or, in the absence of such principles, in conformity with the law applicable by virtue of the rules of private international law.
