New article 87 bis of the Penal Code, which concerns the characterization of acts of terrorism, defines as terrorist or subversive all acts intended:
وتنص المادة الجديدة ٨٧ مكررا من قانون العقوبات - وهي تتعلق بالتكييف القانوني لﻷعمال الارهابية - على ما يلي: " يعتبر عملا إرهابيا أو تخريبيا كل عمل يرمي الى:

(c) Lesbian, bisexual and transgender women who are victims of discrimination and criminalization (art. 347 bis of the Penal Code);
(ج) السحاقيات، والنساء مشتهيات الجنسين والنساء مغيّـرات الهوية الجنسية ضحايا التميـيز والتجريم (المادة 347 مكررا من قانون العقوبات)؛

Article 266: Infringements of health, hygiene and general-prevention regulations and standards shall carry, without prejudice to disciplinary and administrative penalties, criminal penalties, in accordance with the legislation in force, in particular, articles 441 bis, 442 bis and 443 bis of the Penal Code. "

Thus, although there is no definition of terrorism in Argentine domestic law, criminal acts committed by terrorists would necessarily fall under the provisions on various forms of illegal associations set out in articles 210, 210 bis and 213 bis of the Penal Code, merely on the grounds of the perpetrators' membership in such associations.

In this case, and without prejudice to any responsibility that may apply if a terrorist crime results (as stipulated in article 294 bis of the Penal Code), the penalty is short-term imprisonment (medium degree), on the understanding that the unlawful association was formed for the commission of crimes (article 294 of the Penal Code), increased in both cases by one degree (article 3 of Act No. 18.314).

22. JS6 pointed out that, under article 347 (bis) of the Penal Code, sexual relations with a person of the same sex were punishable by a prison sentence of between 6 months and 5 years and a fine.

Regarding the definition of terrorism, article 97 bis of the Penal Code stipulated that “An act of terrorism or subversive act shall be deemed to be any act directed against the security of the State or the integrity of its territory, or the stability or smooth operation of institutions through any action intended, inter alia, to exploit impediments to traffic or freedom of movement caused by riotous assembly”.

Under article 99 bis of the Penal Code, any person who illicitly imports or exports or who traffics in the sensitive goods defined in article 1 of the Sensitive Materials Control Act of 4 March 1999 in an amount equal to or greater than 1 million pesetas (6,000 euros) shall incur a prison sentence of up to two years and a fine of 5 million pesetas (Euro30,000), the latter being no less than the value of the goods.

In addition, the Committee would like to receive further details of the actual application of articles 4 and 6 of the Convention, including through examples of recent court decisions, if any, particularly with respect to article 86 bis of the Penal Code (Act No. 58 of 1937), as amended by Act No. 97 of 18 July 1992.

In particular, with regard to the recent measures taken to implement article 4 of the Convention, note is taken of article 86 bis of the Penal Code (Act No. 58 of 1937), as amended by Act No. 97 of 18 July 1992; however information is not provided as to how this provision of the Penal Code is applied in practice.

191. Under article 242 bis of the Penal Code, which was added to the Code pursuant to Act No. 126 of 2008), female genital mutilation is a criminal offence punishable by a term of imprisonment or a fine.
