Variant 3 received considerable support as providing a precise and simple rule, which put the parties on notice that, if they did not express their agreement to apply the Rules as in effect on the date of their agreement, then the Rules as in effect on the date of the commencement of the arbitration should be presumed to apply.

To avoid confusion, she suggested the following wording: " Article 1, paragraph (2), of the 2010 UNCITRAL Arbitration Rules defines the date after which the parties to an arbitration agreement are presumed to have referred to the Rules in effect on the date of commencement of the arbitration.

6. Mr. Loken (United States of America) said that, in paragraph 9, the phrase " a presumption from which date on parties to an arbitration agreement were presumed to have referred to the Rules in effect on the date of commencement of the arbitration " was confusing.

It was also considered whether the language of a new paragraph (4) of article 1 of the UNCITRAL Arbitration Rules should be evolutive in nature, and include language such as " as amended from time to time " or " in effect on the date of commencement of the arbitration " .

It was pointed out that option 1, variant 2, contained an additional sentence providing that " [T]he Rules on Transparency shall also apply (...), if the treaty provides for application of the version of the UNCITRAL Arbitration Rules as in effect at the date of commencement of the arbitration " .
