15. In considering the implementation of the request to transfer responsibility for formulating decisions on appeals, the following factors were taken into account:

Recalling that the General Assembly, in paragraph 17 of its resolution 59/283, had requested the Secretary-General to transfer responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General, the Advisory Committee recommended that the unit should be placed elsewhere in the Organization, for example, in the Executive Office of the Secretary-General.

In paragraph 17 of its resolution 59/283, the General Assembly decided that measures should be taken to eliminate the appearance of conflict of interest and to this end requested the Secretary-General to proceed with the transfer of the responsibility for formulating decisions on appeals from the Department of Management of the Secretariat to the Office of the Secretary-General.

22. In its resolution 59/283, the General Assembly decided that measures should be taken to eliminate the appearance of a conflict of interest and, to that end, requested the Secretary-General to proceed with the transfer of responsibility for formulating decisions on appeals from the Office of the Under-Secretary-General for Management to the Executive Office of the Secretary-General.

The decrease includes the outward transfer of one P-5 post from this section to section 1, Overall policymaking, direction and coordination to implement paragraph 17 of resolution 59/283, in which the General Assembly requested the transfer of responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General.

In this connection, the Committee recalls paragraph 17 of General Assembly resolution 59/283 in which the Assembly called for measures that should be taken to eliminate the appearance of conflict of interest, and towards that end requested the Secretary-General to proceed with the transfer of responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General.

14. Concerning the OIOS recommendation to transfer responsibility for preparing decisions on appeals outside the Department of Management, the Secretary-General notes that, aside from the Office of the Secretary-General, the only possible other Secretariat unit to which the function could be transferred would be the Office of Legal Affairs.
14 - وفيما يتعلق بتوصية المجلس المتعلقة بنقل المسؤولية عن إعداد قرارات البت في الطعون خارج إدارة الشؤون الإدارية، يلاحظ الأمين العام أنه، فيما عدا مكتب الأمين العام، فإن الوحدة الوحيدة في الأمانة العامة التي يمكن أن تُنقل إليها الوظيفة هي مكتب الشؤون القانونية.

This is because the Office of Legal Affairs acts as respondent in defending the Secretary-General's decisions on appeals before the Administrative Tribunal and could not, therefore, at the same time be the office responsible for preparing those decisions.
