١٤٣ - وينبغي أن تمنح اﻷولوية لاعتماد قانون جنائي جديد يعرﱢف التعذيب بوصفه جريمة يعاقب عليها، وقانون جديد لﻹجراءات الجنائية يضمن حق المتهم في الاستعانة بمحام في جميع مراحل اﻹجراءات الجنائية، وكذلك حقه في اﻹشراف الفعال والعملي من جانب المحاكم على الاحتجاز اﻷوﱠلي لمنع أي استخدام للتعذيب في مرحلة الاحتجاز أو الاعتقال أو في مراحل لاحقة من اﻹجراءات الجنائية.

The Committee is particularly concerned at reports that detainees are frequently denied access to an independent lawyer of their choice, that police officers forcibly extract confessions in the early stages following apprehension, before formal detention or arrest, and that in practice lawyers need to secure special permission from investigators to have access to their clients (arts. 2, 11, 12, 13, 15 and 16).
وتعرب اللجنة عن قلقها البالغ إزاء التقارير التي تفيد بأن السجناء كثيراً ما يُمنعون من الاتصال بمحام مستقل من اختيارهم ومن انتزاع ضباط الشرطة للاعترافات بالقوة خلال المراحل الأولى التي تلي عملية الحبس قبل الاحتجاز أو الاعتقال الرسمي ويجب على المحامين، في الواقع العملي، الحصول على ترخيص خاص من المحققين للاتصال بموكليهم (المواد 2 و11 و12 و13 و15 و16).

During August and September 2013, the Public Prosecutor's Office carried out an inspection of the detention conditions and the reasons for detention or arrest in all jails and holding and detention centres throughout the country.
