In its General Comment on article 9 of the Covenant, the Human Rights Committee recalls that " Article 9 which deals with the right to liberty and security of persons has often been somewhat narrowly understood in reports by States parties, and they have therefore given incomplete information.

The prohibition of arbitrary detention also extends to situations where detention is used for " educational purposes " (see Human Rights Committee general comment No. 8 (1982) on the right to liberty and security of persons).

The Human Rights Committee has interpreted the content and scope of the right to challenge the lawfulness of detention in its general comment no. 8 (1982) on article 9 (right to liberty and security of persons) and in its jurisprudence.
