65. With regard to the right to defence in legal proceedings, it had to be exercised through a legally registered lawyer freely chosen by the litigant.

Case law considers that a case has no chance of success if the prospects of winning it are considerably less than losing it and if success cannot be seen as a serious possibility, to the extent that a reasonable, well-off litigant would not embark on the procedure on account of the costs they would be liable to incur.

4-4- لا يشترك القاضي في الفصل في قضية يكون فيها أي فرد من أفراد عائلته ممثلا لأحد الأطراف المتقاضية أو مرتبطا بأية كيفية بالقضية.

Respecting the rights of the defence means that the litigant can have the assistance of counsel and of an interpreter from the outset of a criminal investigation.
