Pursuant to article 15 (1) of the Constitution, the family is the natural and fundamental unit of society and is entitled to the protection of the law, the right of a woman and man to marry and found a family must be recognized, in accordance with the personal status laws applicable each of them, and no marriage can be entered into without the free and full consent of both parties.

42. The Committee notes with appreciation that both the Transitional Civil Code of Eritrea and the draft Civil Code define children as all persons under the age of 18, and that the Constitution states that men and women of full legal age shall have the right, upon their consent, to marry and found a family freely.
