In this connection, the Committee reiterates its view, as expressed in its General Comment 20 (44), that this type of amnesty is incompatible with the duty of States to investigate human rights violations, to guarantee freedom from such acts within their jurisdiction, and to ensure that they do not occur in the future.

The Special Rapporteur further wishes to refer to the jurisprudence of the Human Rights Committee, which, in its General Comment 20, of 3 April 1992, on the prohibition of torture, concluded that amnesties are generally incompatible with the duty of States to investigate such acts of torture; to guarantee freedom from such acts within their jurisdiction; and to ensure that they do not occur in future.
29 - ويود المقرر الخاص كذلك الإشارة إلى الرأي الفقهي للجنة حقوق الإنسان التي خلصت في ملاحظتها العامة 20 المؤرخة 3 نيسان/أبريل 1992 المتعلقة بحظر التعذيب إلى أن العفو يتناقض، بوجه عام، مع واجب الدول في التحقيق في هذه الأفعال التعذيب؛ وضمان الحماية منها في دائرة ولايتها، والسهر على ألا تحدث ثانية في المستقبل.
