110. The Declaration on the Elimination of Violence against Women and the Beijing Platform for Action address violence against women according to the site, or setting, where it occurs: in the family; within the general community; and perpetrated or condoned by the State.

In its decision 17/1, the Commission strongly condemned all acts of violence against women and girls, including violence against women migrants and women migrant workers, whether those acts were perpetrated by the State, by private persons or by non-State actors, and called for the elimination of all forms of gender-based violence in the family, within the general community and where perpetrated or condoned by the State.

39. Violence perpetrated or condoned by the State may include gender-based violence during conflict, custodial violence, violence against refugees and internally displaced persons as well as against women from indigenous and minority groups.74

In follow up to her previous report on violence against women as perpetrated and/or condoned by the State (E/CN.4/1998/54), the present report focuses on violence against women in armed conflict, specifically in terms of the recommendations made in the Special Rapporteur's report to the Commission on Human Rights in 1998.
