The personnel of PMSCs are obliged to respect the relevant national law, in particular the national criminal law, of the State in which they operate, and, as far as applicable, the law of the States of their nationality.

take measures to suppress violations of international humanitarian law committed by the personnel of PMSCs through appropriate means, such as military regulations, administrative orders and other regulatory measures as well as administrative, disciplinary or judicial sanctions, as appropriate.

4- تكفل كل دولة طرف أن يتقيد موظفو الشركات العسكرية والأمنية الخاصة تقيداً صارماً بالمعايير ذات الصلة من القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي، متبعة سيلاً منها إجراء تحقيق فوري مع مرتكبي انتهاكات القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي ومقاضاتهم ومعاقبتهم.

1. Each State party shall take such measures as may be necessary to establish its jurisdiction over other crimes committed by the personnel of PMSCs in providing their services in the territory of another State party or State not party to this Convention.
1- تتخذ كل دولة طرف ما يلزم من تدابير لإقامة ولايتها القضائية على الجرائم الأخرى التي يرتكبها موظفو الشركات العسكرية والأمنية الخاصة أثناء تقديم خدماتهم في إقليم دولة طرف أخرى أو دولة ليست طرفاً في الاتفاقية.

2. Any specific jurisdiction or legal matters related to the investigations of crimes committed by the personnel of PMSCs in providing their services in the territory of another State party or State not party to the present Convention, or agreements of extradition, may be regulated by an additional international agreement concluded between these States.
2- يجوز تنظيم أي ولاية قضائية أو شؤون قانونية محددة تتعلق بالتحقيق في الجرائم التي يرتكبها موظفو الشركات العسكرية والأمنية الخاصة أثناء تقديم خدماتهم في إقليم دولة طرف أخرى أو دولة ليست طرفاً في هذه الاتفاقية، أو اتفاقات التسليم، بموجب اتفاق دولي إضافي يُبرم بين هذه الدول.
