Although the Assembly considered that it may be premature to develop such regulations immediately, it was noted during the sixteenth session that, as part of the programme of work for the period 2011-2013, the secretariat will commission a preliminary study of some of the issues associated with developing an exploitation code, and will also hold a workshop or seminar to review and discuss the issues raised by such a study.

The Special Rapporteur considers it useful to recall that, according to his mandate, this study was not to be limited to an analysis of past legal instruments and their contemporary significance, nor to a review of whether or not they are being currently implemented, regardless of the value that such a review might have for both the present and the future.

The State party had on 11 June 2008 requested the Committee to clarify what it had meant by " review " , unsure whether that meant to request a government commission to study the Committee's recommendations and decide whether or not to change the system or whether more radical changes were required and, if so, what manner of changes.

Moreover, the three main elements affecting competition policies and laws - intellectual property protection, trade in services, trade-related aspects of investment - were all relevant to business practices either at a national or international level and hence should be examined in depth in the study to be prepared for the Third review Conference.

The above notwithstanding, the Inspectors could not find any independent cross-cutting study performed on what are the actual results achieved, on a United Nations system-wide basis, in terms of national ownership, system-wide harmonization in capacity-building in line with the Triennial Comprehensive Policy review (TCPR) and the QCPR, or on the question of who is ultimately responsible for programme delivery and results.

Therefore, the organization respectfully requests that the annual ministerial review declaration include a specific paragraph to that effect and/or recommend a specific study of the role of mutuals as natural complements to the State in order to achieve the Millennium Development Goal target of achieving full and productive employment and decent work for all, including women and young people.

In its resolution 2005/36, the Commission invited the Special Rapporteur on contemporary forms of racism, racial discrimination, xenophobia and related intolerance to review and further expand the study on the question of political platforms which promote or incite racial discrimination (E/CN.4/2004/61), as updated for the General Assembly (A/59/330), and to submit it to the Commission at its sixty-second session.

Lastly, the Special Rapporteur will place particular emphasis on follow-up to recommendations made in her own reports or in other documents such as the reports of the Working Group on the universal periodic review, the final comments of the Committee on the Rights of the Child and the United Nations study on Violence Against Children, provided, of course, that they come within the scope of her mandate.

From a review and analysis of reports coming from the reception centre in Harad and of the conclusions of the study made in 2004, it appears that about 90 per cent of the children smuggled are employed as labourers or are used in goods smuggling operations and that the remaining 10 per cent are exploited as beggars in Saudi Arabia.
