20. The process of administration of justice in the United Nations is initiated by a written request to the Secretary-General to review a contested decision (see chapter XI of the Staff Regulations and Rules).

There are reported cases by investigators of double contracting/billing by some IPs to multiple donors for activities related to the same programmes (see chapter XI). This is an inherent risk the occurrence of which, albeit not common, needs to be addressed and mitigated.

Another important factor for the implementation of privately-financed infrastructure projects is the legal framework in the host country for the settlement of disputes (see chapter XI, “Settlements of disputes”, ).

This is especially the case where the owner's assets, although in the grantor's possession, are determined to not be part of the insolvency estate, by contrast with the situation where the grantor's assets, if merely encumbered by a security right for the creditor, are deemed to be part of the insolvency estate (see chapter XI on insolvency; A/CN.9/631/Add.8).

This chapter examines the secured creditor's right to enforce its security right if the grantor fails to perform ( " defaults on " ) the secured obligation prior to the institution of insolvency proceedings or, with the permission of the appropriate body, during insolvency (see chapter XI). In section A.2 of the chapter, the general principles guiding default and enforcement are discussed.

In that connection, the Chairman recalled that at the same meeting, on 16 March 2007, the Commission had approved the draft provisional agenda for its fifty-first session, which included an item entitled " Preparation for the ministerial-level segment at the fifty-second session of the Commission " . Thus, the importance can be seen of having in place clear rules concerning the operation of the infrastructure facility and of establishing adequate methods for settling disputes between the host Government and the project company that might arise at that phase of the project (see chapter XI, “Settlement of disputes”, ___).

In some countries, there are special provisions for the settlement of disputes arising out of Government contracts, and there may be limitations to the right of governmental agencies to agree on non-judicial procedures for settlement of disputes (see chapter XI, “Settlement of disputes”, ___).

In addition, the legislation organizing the sector, investment protection treaties, and licence or contractual provisions often address the right of investors to resort to international commercial arbitration between the Government and the affected entity in case of a perceived breach of contract (see chapter XI, “Settlement of disputes”, ).

The training material that could be used as a basis for national workshops on ranking and prioritization has been included in a LEG publication containing examples and exercises drawn from the NAPA workshops (see chapter XI). The LEG will continue to monitor progress on the fulfilment of this important step in the NAPA process and to respond to requests for support and guidance thereon.

Except in connection with the non-unitary approach to acquisition financing (see chapter XI on acquisition financing), whether a creditor seeks to obtain a preference by means of either the principle of the common pledge or the principle of creditor equality, the particular means by which it does so will be a matter for secured transactions law (see chapter III, Basic approaches to security, recommendation 11).
