A term in the contract of carriage according to which the liability of the shipper or the documentary shipper will cease, wholly or partly, upon a certain event or after a certain time is void:

On reflection, the solution proposed -- that, in the event the holder did not claim delivery of the goods, the carrier should seek instructions from the controlling party, the shipper or the documentary shipper -- seemed acceptable.

Accordingly, the consignee, for example, would not be deprived of its rights to claim delivery under a transport document if draft article 38 had not been entirely or accurately complied with owing to an error or omission of the shipper or the carrier.

The question was not merely one of obligations regarding loading and unloading, since other articles of the draft convention also dealt with those, but rather of financial responsibility for property, which would pose no problem if all loading and unloading operations were carried out by the carrier alone and not the shipper or consignee.

145. There was some support for the view that, while problematic, delay should not too easily be discarded as a basis of liability, and it was suggested that it could be considered as a separate basis of liability, whether caused by the shipper or the carrier.
145- وأُبدي بعض التأييد للرأي القائل بأن التأخر، رغم إشكاليته، لا ينبغي إسقاطه بتلك السهولة كأساس للمسؤولية، ورُئي أنه يمكن اعتباره أساسا منفصلا للمسؤولية، سواء تسبّب فيه الشاحن أو الناقل.

(h) A bill of lading contains an arbitration clause that is not signed by the shipper or the subsequent holder.
(ح) احتواء سند شحن على شرط بشأن التحكيم دون أن يكون ذلك الشرط موقَّعا عليه من الشاحن أو من الحائز اللاحق؛

It was noted that, unlike the identifying numbers of containers, the identifying numbers of container seals might not be known to the carrier, as seals might be placed by parties other than the shipper or the carrier, such as customs or sanitary authorities.
وذُكر أن الأرقام المعرِّفة لأختام الحاويات، خلافا للأرقام المعرِّفة للحاويات، قد لا تكون معروفة للناقل، لأن الأختام قد تضعها أطراف غير الشاحن أو الناقل، مثل السلطات الجمركية أو السلطات المعنية بالإصحاح.

In particular, the view was expressed that draft article 49 undermined the function of a negotiable transport document as a document of title by allowing carriers to seek alternative delivery instructions from the shipper or the documentary shipper and thus removing the requirement to deliver on the presentation of a bill of lading.
