To facilitate and guide the discussion, the Chairman put forward a list of questions formulated in the context of certain specific articles of the draft statute prepared by the International Law Commission.

The General Assembly would also decide that the work of the Preparatory Committee will be based on the draft statute prepared by the International Law Commission and that, in such work, due account will be taken of the report of the Ad Hoc Committee, of the written comments submitted by States to the Secretary-General on the draft statute for an international criminal court and, as appropriate, of the contributions of relevant organizations.

The General Assembly, in its resolution 49/53 of 9 December 1994, decided to establish an ad hoc committee to review the major substantive and administrative issues arising out of the draft statute prepared by the International Law Commission and, in light of that review, to consider arrangements for the convening of an international conference of plenipotentiaries.
٥ - وقررت الجمعية العامة، في قرارها ٩٤/٣٥ المؤرخ ٩ كانون اﻷول/ ديسمبر ٤٩٩١، إنشاء لجنة مخصصة كي تستعراض القضايا الرئيسية الفنية واﻹدارية الناشئة عن مشروع النظام اﻷساسي الذي أعدته لجنة القانون الدولي، ولتنظر، في ضوء ذلك الاستعراض، في أمر الترتيبات اللازمة لعقد مؤتمر دولي للمفوضين.

6. The Ad Hoc Committee on the Establishment of an International Criminal Court met from 3 to 13 April and from 14 to 25 August 1995, during which time the Committee reviewed the issues arising out of the draft statute prepared by the International Law Commission and considered arrangements for the convening of an international conference.
٦ - واجتمعت اللجنة المخصصة ﻹنشاء محكمة جنائية دولية في الفترتين من ٣ إلى ٣١ نيسان/أبريل ومن ٤١ إلى ٥٢ آب/أغسطس ٥٩٩١، واستعرضت خلالهما القضايا الناشئة عن مشروع النظام اﻷساسي الذي أعدته لجنة القانون الدولي، ونظرت في الترتيبات اللازمة لعقد مؤتمر دولي.

Noting also that the States participating in the Ad Hoc Committee still have different views on major substantive and administrative issues arising out of the draft statute prepared by the International Law Commission and that, therefore, further discussions are needed for reaching consensus on the above issues in the future,
وإذ تحيط علما أيضا بأنه لا يزال هناك خلاف في آراء الدول المشاركة في اللجنة المخصصة بشأن القضايا الفنية واﻹدارية الرئيسية الناشئة عن مشروع النظام اﻷساسي الذي أعدته لجنة القانون الدولي، وأن الحاجة تدعو بالتالي إلى إجراء مزيد من المناقشات من أجل التوصل في المستقبل إلى توافق في اﻵراء بشأن القضايا المشار إليها أعلاه،

(b) The work of the Preparatory Committee would be based on the draft statute prepared by the International Law Commission and would take into account the report of the Ad Hoc Committee on the Establishment of an International Criminal Court and the written comments submitted by States to the Secretary-General on the draft statute for an international criminal court;
)ب( سيستند عمل اللجنة التحضيرية إلى مشروع النظام اﻷساسي الذي أعدته لجنة القانون الدولي، كما سيراعى فيه تقرير اللجنة المخصصة ﻹنشاء محكمة جنائية دولية والتعليقات الخطية المقدمة من الدول إلى اﻷمين العام بشأن مشروع النظام اﻷساسي لمحكمة جنائية دولية؛

2. Decides to establish an ad hoc committee, open to all States Members of the United Nations or members of specialized agencies, to review the major substantive and administrative issues arising out of the draft statute prepared by the International Law Commission and, in the light of that review, to consider arrangements for the convening of an international conference of plenipotentiaries;
٢ - تقرر إنشاء لجنة مخصصة مفتوحة العضوية أمام جميع الدول اﻷعضاء باﻷمم المتحدة أو أعضاء الوكالات المتخصصة لتتولى استعراض المسائل الفنية واﻹدارية الرئيسية الناجمة عن مشروع النظام اﻷساسي الذي أعدته لجنة القانون الدولي، ولتنظر، على ضوء ذلك الاستعراض، في أمر الترتيبات اللازمة لعقد المؤتمر الدولي للمفوضين؛

Article 1, a standard provision, differed from that contained in the draft statute prepared by the International Law Commission (ILC) to the extent that, on a Norwegian proposal and following informal consultations and agreement, it included a very general reference to the concept of complementarity, in order to meet certain concerns about the symbolism and image of the very first article of the draft Statute.

The work would involve amendments to the draft statute prepared by the International Law Commission, particularly to the list of crimes falling within the jurisdiction of the court.
