24. Many delegations noted that the existing international framework for the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction was fragmented and did not address cumulative impacts.

We have noted a broad need to address both the shortcomings in implementation and existing gaps in the institutional framework in order to fulfil our collective obligations related to the conservation and sustainable use of marine biodiversity in these areas.

5. Identification of gaps and ways forward, with a view to ensuring an effective legal framework for the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction, within the process initiated by the General Assembly in accordance with resolution 66/231.

The Working Group had recommended that a process be initiated, by the General Assembly with a view to ensuring that the legal framework for the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction effectively addressed those issues by identifying gaps and ways forward, including through the implementation of existing instruments and the possible development of a multilateral agreement under the Convention.

This process would address the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction, in particular, together and as whole, marine genetic resources, including questions on the sharing of benefits, measures such as area-based management tools, including marine protected areas, and environmental impact assessments, capacity-building and the transfer of marine technology.

In particular, the UN-Oceans Task Force on Biodiversity in Areas beyond National Jurisdiction reported, inter alia, on progress in the compilation of information on existing tools provided for under relevant international instruments for the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction.

We also welcome the meeting in 2011 of the Ad Hoc Open-ended Informal Working Group to study issues related to the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction, which we hope will make progress in finding ways forward to ensuring the conservation and sustainable and equitable use of that biodiversity.

The European Union and its Member States also note with great satisfaction the results of the two intersessional workshops held at United Nations Headquarters in May 2013, with a view to improving understanding of the issues related to the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction and clarifying key questions as an input to the work of the Working Group.

Concern was also expressed regarding investments in those initiatives while there was no universal regime for addressing the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction.
