7.4 With regard to the author's claim that his rights under article 18, paragraph 1, of the Covenant were violated, the Committee notes that the present communication was submitted by the author in his own name, whereas the written warning of the Authorized person was addressed to the Consistory of the Religious Union and not to the author as an individual follower of Lutheran beliefs.

297. Where the court acquits the defendant or dismisses the charges or suspends the criminal procedure, the Authorized person is instructed to initiate civil procedure to claim damages.

5-2 ويفيد صاحب البلاغ بأنه على الرغم من أنه لم يوافق على عدد من النقاط المذكورة في الإنذار الخطي الوارد من الشخص المرخص له والمؤرخ 24 تشرين الثاني/نوفمبر 2006، فإنه لم يتمكن من الطعن في المسائل المختلف عليها أمام المحكمة، لأن القانون " المتعلق بحرية الوجدان والمنظمات الدينية " لا يتضمن حكماً يبين المحكمة التي ستكون مختصة بالنظر في الإنذارات الخطية الموجهة إلى المنظمات الدينية.

If the Authorized person is subject simultaneously to the proceedings undertaken by the Authority for violation of the mandatory principles, rules, regulations and procedures issued by the Authority in connection with prospecting or activities in the Area and by the Ministry for violation of the provisions of the Act, the Ministry shall suspend the proceedings until it receives a valid decision of the Authority.

2.2 On 24 November 2006, the Authorized person on the issues of religion and nationalities under the Council of Ministers of Belarus (the Authorized person) issued a written warning to the Religious Union about a violation of the law " On the freedom of conscience and religious organizations. "

2.10 On 27 March 2007, the author was informed by the Chairperson of the Commission on Human Rights, National Relations and Mass Media that the issues raised in his letter of 15 February 2007 were discussed with the Authorized person who was of the opinion that the amendments to the " On the freedom of conscience and religious organizations " were impractical at that point in time.

298. Where the court declares lack of jurisdiction for the criminal procedure the Authorized person will be instructed to submit the claim for damages within the criminal procedure that will be started or continued by the court with jurisdiction.
