8- وفي ضوء ما ورد ذكره أعلاه، تستنتج لجنة مناهضة التعذيب، عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن القرار الذي اتخذته الدولة الطرف بشأن إعادة صاحبة الشكوى إلى إثيوبيا لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

It would appear that recommendations are -- by their nature -- non-binding acts and that for an internationally wrongful act to be committed as a consequence of a recommendation there needs to be an intervening act -- the decision of the State or another international organization to commit that act.

In the circumstances the Committee, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, is of the view that the decision of the State party to return the author to Sri Lanka would not constitute a breach of article 3 of the Convention.
٧ - وفي هذه الظروف، ترى لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة ٧ من المادة ٢٢ من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن القرار الذي اتخذته الدولة الطرف بإعادة مقدم البلاغ إلى سري لانكا لن يشكل انتهاكا للمادة ٣ من الاتفاقية.

8. In the light of the above, the Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the decision of the State party to expel the complainants to Yemen would not constitute a violation of article 3 of the Convention.
8- وفي ضوء ما ورد ذكره أعلاه، تخلص لجنة مناهضة التعذيب، وهي تتصرف عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن القرار الذي اتخذته الدولة الطرف بشأن إعادة أصحاب الشكوى إلى اليمن لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

A similar view was expressed by ILO, which noted that in the case of a recommendation " there needs to be an intervening act -- the decision of the State or another international organization to commit that act.
وأعربت منظمة العمل الدولية عن وجهة نظر مماثلة، حيث لاحظت أنه في حالة التوصية " لا بد أن يكون هناك تصرّف - أي قرار من الدولة أو المنظمة الدولية بأن تقوم بذلك الفعل.
