A contracting authority should not impose any criterion, requirement or procedure with respect to the qualifications of bidders which has not been set forth in the preselection documents.
وينبغي أن لا تفرض الهيئة المتعاقدة أي معيار أو اشتراط أو اجراء بخصوص مؤهلات مقدمي العروض لم يكن منصوصا عليه في وثائق الاختيار اﻷولي .

In any event, where such a rating system is to be used, that circumstance should be clearly stated in the preselection documents.
وأيا كان اﻷمر ، فعندما يعتزم استخدام نظام ترتيب كهذا ، ينبغي أن يذكر ذلك بوضوح في مستندات الاختيار اﻷولي .

Where preselection proceedings have been used, the criteria shall be the same as those used in the preselection proceedings.

1. Invitation to the preselection proceedings
١ - الدعوة الى اجراءات الاختيار اﻷولي

The laws of many countries identify publications, usually the official gazette or other official publication, in which the invitation to the preselection proceedings is to be published.
وتحدد قوانين بلدان كثيرة المنشورات التي ينبغي أن تنشر فيها الدعوة الى اجراءات الاختيار اﻷولي ، وهي في العادة الجريدة الرسمية أو غيرها من المنشورات الرسمية .

For purposes of transparency, it is desirable for the law to provide that, where the contracting authority reserves the right to reject a proposal on those or similar grounds, adequate notice of that circumstance must be included in the invitation to the preselection proceedings.
وﻷغراض الشفافية ، من المستحسن أن ينص القانون على أنه في حال احتفاظ الهيئة المتعاقدة بالحق في رفض اقتراح ما بناء على تلك اﻷسباب أو أسباب مماثلة ، يجب أن تتضمن الدعوة الى اجراءات الاختيار اﻷولي اشعارا ملائما بذلك .

For the purpose of facilitating the liaison with the contracting authority, it may be useful to require in the preselection documents that each consortium should designate one of its members as a focal point for all communications with the contracting authority.

كما أن الرد على أي طلب يتوقع بدرجة معقولة أن يهم مقدمي عروض آخرين ، ينبغي أن يبلـغ ، دون تحديد مصدر الطلب ، الى جميع مقدمي العروض الذين زودتهم الهيئة المتعاقدة بوثائق الاختيار اﻷولي .

From the perspective of the contracting authority, it is generally advisable to exercise caution in respect of proposed substitutions of individual members of bidding consortia after the closing of the preselection phase.
ومن المستصوب عامة من منظور الهيئة المتعاقدة توخي الحذر بخصوص مقترحات تبديل أعضاء في كونسورتيومات مقدمي العروض بعد اختتام مرحلة الاختيار اﻷولي .

The bidders should demonstrate that they meet the preselection criteria which the contracting authority considers appropriate for the particular project, including:
التوصية ٥١- ينبغي لمقدمي العروض أن يثبتوا أنهم يستوفون معايير الاختيار اﻷولي التي تعتبرها السلطة المتعاقدة مناسبة للمشروع المعين، بما في ذلك:

The contracting authority should elaborate a short list of the preselected bidders which will be subsequently invited to submit proposals upon completion of the preselection phase.
التوصية ٧١- ينبغي للسلطة المتعاقدة أن تعد قائمة قصيرة بمقدمي العروض ممن وقع عليهم الاختيار اﻷولي الذين سيدعون في وقت لاحق الى تقديم اقتراحات عند اتمام مرحلة الاختيار اﻷولي.

Upon completion of the preselection proceedings, the contracting authority should invite the preselected bidders to submit final proposals.
التوصية ٨١- عند اتمام اجراءات الاختيار اﻷولي، ينبغي للسلطة المتعاقدة أن تدعو مقدمي العروض الذين وقع عليهم الاختيار اﻷولي الى تقديم اقتراحات نهائية.

That any margin of preference for national bidders or bidders who offer to procure supplies, services and products in the local market should be applied at the evaluation phase and must be announced in the invitation to the preselection proceedings;
)ج( أن أي هامش تقضيل لمقدمي عروض وطنيين أو غيرهم ممن يعرضون اشتراء لوازم أو خدمات أو منتجات في السوق المحلية ، ينبغي أن يطبق في مرحلة التقييم ويجب أن يعلن في الدعوة الى اجراءات الاختيار اﻷولي ؛

In traditional Government procurement, preselection proceedings may consist of the verification of certain formal requirements, such as adequate proof of technical capability or prior experience in the type of procurement, so that all bidders who meet the preselection criteria are automatically admitted to the tendering phase.
ففي الاشتراء الحكومي التقليدي ، قد تتألف اجراءات الاختيار اﻷولي من التحقق من الوفاء بشروط رسمية معينة ، مثل وجود البرهان الملائم على توافر القدرة التقنية أو الخبرة السابقة في نوع الاشتراء المطلوب ، بحيث يشارك تلقائيا في مرحلة تقديم العطاءات جميع مقدمي العروض الذين يستوفون معايير الاختيار اﻷولي .

In order to promote transparency and competition, it is advisable that the invitation to the preselection proceedings be published in a manner that reaches an audience wide enough to provide an effective level of competition.
٠٤ - بغية تشجيع الشفافية والتنافس ، من المستصوب أن تنشر الدعوة الى اجراءات الاختيار اﻷولي بطريقة تجعلها تبلغ جمهورا واسعا يكفي لتوفير مستوى فعال من التنافس .

(g) " Preselection documents " means documents issued by the procuring entity under article 48 (3) of this Law that set out the terms and conditions of the preselection proceedings;
(ز) يعني التعبير " وثائق الاختيار الأوّلي " ما تصدره الجهة المشترية من وثائق تبيِّن أحكام وشروط إجراءات الاختيار الأوّلي، وفقاً للمادة 48 (3) من هذا القانون؛
