Following that approach, it was suggested to insert language modelled on paragraph 45 of the Explanatory Note by the UNCITRAL secretariat on the Model Law, along the lines of: " In regulating recourse, this paragraph does not preclude a party from seeking court control by way of defence in enforcement proceedings. "
واتّباعاً لهذا النهج، اقتُرح إدراج عبارة تُصاغ على شاكلة الفقرة 45 من المذكرة التفسيرية التي أعدّتها أمانة الأونسيترال بشأن القانون النموذجي على غرار التالي: " في إطار تنظيم الطعن، لا تمنع هذه الفقرة أي طرف من أن يلتمس من المحكمة، على سبيل الدفاع، التدخل بأي طريقة في إجراءات الإنفاذ. "

The Working Group confirmed that the term " recourse " used in the third sentence of article 32, paragraph (2) was never intended to refer to a ground for resisting enforcement under the New York Convention or under article 36 of the Model Law, and referred on that matter to the explanations contained under paragraph 45 of the Explanatory Note by the UNCITRAL secretariat on the Model Law.
وأكّد الفريق العامل أن مصطلح " الطعن " المستخدم في الجملة الثالثة من الفقرة (2) من المادة 32 لم يُقصد منه قط الإشارة إلى أي من أسس مقاومة الإنفاذ بمقتضى اتفاقية نيويورك أو بمقتضى المادة 36 من القانون النموذجي، وأشار في هذا الصدد إلى الشروح الواردة في إطار الفقرة 45 من المذكرة التفسيرية التي أعدّتها أمانة الأونسيترال بشأن القانون النموذجي.

However, according to the Explanatory note by the UNCITRAL secretariat on the Model Law on International Commercial Arbitration (the Explanatory note on the Model Law), the term " recourse " was selected to mean actively " attacking " the award, which should be distinguished from seeking court control by way of defence in enforcement proceedings (article 36 of the Model Law).
ولكن وفقا لما جاء في المذكرة الإيضاحية من أمانة الأونسيترال بشأن القانون النموذجي للتحكيم التجاري الدولي (المذكرة الإيضاحية بشأن القانون النموذجي) فإنّ مصطلح " الطعن " اُختير ليعني " هجوما " قاسيا على القرار، وهو ما ينبغي تمييزه عن طلب رقابة المحكمة بواسطة دفع يتعلّق بتنفيذ الإجراءات ( المادة 36 من القانون النموذجي).

22. His delegation noted with satisfaction that a search engine had been placed on the Web site of the UNCITRAL secretariat on the Internet to enable users of case law on UNCITRAL texts (CLOUT) to carry out searches into CLOUT cases and other documents.
٢٢ - وأوضح أن وفده يلاحظ بارتياح تزويد موقع أمانة الأونسترال على الإنترنت بأداة للبحث لتمكين مستعملي السوابق القضائية المستندة إلى نصوص الأونسترال من إجراء عمليات بحث في تلك السوابق القضائية وغيرها من الوثائق.
