In this connection, counsel submits that evidence which comes to light after the preliminary hearing, may bring up questions which an accused will wish to put to witnesses against him.

It notes in particular the author's claims that witnesses against him had an interest in the case, that not all the necessary evidence had been assessed, that his confessions were obtained unlawfully, and that his guilt was not established.

One of the fundamentals of the right to due process for everyone charged with a criminal offence is to “examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him”. (Covenant on Civil and Political Rights, art. 14,3 (e)).
