This Declaration of the Establishment of the State of Israel also provides that the State of Israel " will ensure complete equality of social and political rights to all its inhabitants irrespective of religion, race or sex; it will guarantee freedom of religion, conscience, language, education and culture; it will safeguard the Holy Places of all religions " .

Particularly problematic in this regard is not only the use of the term " unlawful combatant " , as discussed earlier in this report, but also its definition, which includes persons who have " indirectly " participated in hostile acts against the State of Israel.

In March 2007, the Committee on the Elimination of Racial Discrimination expressed its concerns about the excavations beneath and around AlAqsa Mosque and urged the State of Israel to ensure that the excavations in no way endanger the mosque and impede access to it (CERD/C/ISR/CO/13, para. 36).

The State of Israel has ratified all the principal instruments for the protection of human rights that protect the right to food, including the International Covenant on Economic, Social and Cultural Rights (art. 11), without reservations on the applicability of these conventions in the occupied territories.

Moreover, section 1 of the 1992 Basic Law " Human Dignity and Liberty " , as amended, provides that fundamental human rights in Israel are founded upon recognition of the value of the human being, the sanctity of human life, and the principle that all persons are free; these rights shall be upheld in the spirit of the principles set forth in the Declaration of the Establishment of the State of Israel.

In addition to laws enacted by the State of Israel during the past 60 years, the legal framework also includes laws from the Ottoman rule (15161917) and from the British mandate period (19201948) as well as religious laws and English laws, including the " substance of common law and the doctrines of equity in force in England " .
