(أ) تعديل قانون العقوبات وإدراج حكم ينص صراحة على تجريم انتهاكات أحكام البروتوكول الاختياري فيما يتعلق بتجنيد وإشراك الأطفال في عمليات قتالية، وإدراج تعريف للمشاركة المباشرة في العمليات القتالية؛

(a) Revise the Penal Code and include a provision which explicitly criminalizes violations of the provisions of the Optional Protocol regarding the recruitment and involvement of children in hostilities and include a definition of direct participation in hostilities;

(ج) ما إذا كانت الدولة الطرف قد قررت الاختصاص القضائي خارج إقليمها على الجرائم المتعلقة بتجنيد وإشراك الأطفال في أعمال قتالية حين يرتكبها، أو حين تُرتكب ضد، مواطن من الدولة الطرف أو تكون له روابط أخرى بها؛

CRC recommended that Kuwait take all necessary measures to establish its jurisdiction over all the offences and situations referred to in OP-CRC-SC and revise its legislation in order to establish extraterritorial jurisdiction for crimes regarding the recruitment and involvement of children in hostilities when they are committed by or against a person who is a citizen of or has other links with Kuwait.
