trade union freedom thus includes the right to form trade unions and to join the trade union of one's choice, as well as the right of trade unions to establish confederations and to form and join international trade union organizations.

74. With reference to article 22 of the Covenant concerning the right to freedom of association with others, including the right to form and join trade unions for the protection of one's interests, the Constitution provides for this freedom in article 34. It also provides that no one shall be required to join or be a member of a group or association established for self-defence or a similar purpose.

The Special Rapporteur emphasizes that the right to form and join an association is an inherent part of the right to freedom of association. It also includes the right to form and join trade unions for the protection of one's interests, as enshrined in the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights.

The Italian Constitution envisages economic rights such as the right to property, the freedom to undertake economic initiatives, the right to work and to freely choose one's work, the right to form trade unions (Art. 39), the right to equal and favourable conditions of work (Art. 36), equal work treatment (Art. 37) and social security (Art. 38).

28.
