The approval of the wali, or guardian, was required for all marriages.

Article 37 of the Code states that where a guardian is not able to give a woman in marriage, the woman herself may ask a court to act in the guardian's place.
ونصت المادة 37 على أنه إذا امتنع الولي عن تزويج المرأة فيجوز لها أن تطلب من المحكمة ذلك.

A woman has the right to have recourse to the judge in the event that the guardian refrains from marrying a woman who has reached the age of 18, which is the legal marriageable age.
ويحق للمرأة اللجوء إلى القاضي في حال امتناع الولي من تزويج من بلغت الثامنة عشر من العمر باعتباره السن القانوني للزواج.

A guardian may not, however, give a 10-year-old girl in marriage without the consent of the judge, which is based on the considerations of advantage and good reason, provided that the husband is suitable and the dowry equals that of the girl's peers.
أما بالنسبة للفتاة في سن العاشرة فلا يعقد الولي زواجها إلا بإذن القاضي لمصلحة وحجة ويشترط كفاءة الزوج ومهر المثل.

(i) If the guardian is sentenced to a term of imprisonment with hard labour or hard labour for life;

Article 13 provides that the approval of the guardian does not have to be sought for the marriage of a previously married woman over 18 years old.
كذلك نصت المادة ١٣ على أنه لا يشترط موافقة الولي في زواج المرأة الثيب العاقلة المتجاوزة من العمر ثمانية عشر عاما.

A guardian in marriage is meant to act on behalf of the woman in the contract proceedings but has no right to declare acceptance or rejection without her consent.
ومهمة الولي في الزواج هي أن ينوب عن الزوجة في مجلس العقد وهو لا يملك حق التصرف بالقبول أو الرفض دون رضاها.

The presence of the guardian is not always a condition for the validity of the contract.
ولا يشترط وجود الولي لصحة العقد دائماً، بحيث تستطيع المرأة الطلب من المحكمة تزويجها مباشرة إذا امتنع الولي عن ذلك.

But it allows a guardian to give an incapacitated person in marriage if there is a clear benefit for the latter.
بيد أن القانون ترك للولي إمكانية تزويج ناقص الأهلية إذا كان ذلك يخدم مصلحة الولي.

Should a guardian disregard these provisions in giving a child in marriage, he shall be subject to the penalties provided for in the Penal Code.
وإذا زوج الولي ناقص الأهلية دون مراعاة مقتضيات هذه الأحكام فإنه يتعرض للعقوبات المنصوص عليها في القانون الجنائي.

The presence of the wali in no way affects the legal personality of adult women.
ووجود الولي لا يؤثر في شيء من الإمكانية المتاحة للمرأة الراشدة.
