ولم يثبت أصحاب البلاغ من جهة أخرى أنه في حالة إعادتهم إلى أي بلد آخر، مثل باكستان، سيتعرضون لإرسالهم إلى أفغانستان حيث يخشون التعرض لمعاملة تتنافى مع المادة 7.

8.4 Referring to the arguments that Mrs. Bakhtiyari and her children, if removed to Afghanistan, would be in fear of being subjected to treatment contrary to article 7 of the Covenant, the Committee observes that as the authors have not been removed from Australia, the issue before the Committee is whether such removal if implemented at the present time would entail a real risk of treatment contrary to article 7 as a consequence.
