Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.
وينبغي أن يحظر القانون أي دعوة إلى الكراهية الوطنية أو العرقية أو الدينية تشكل تحريضا على التمييز أو العـداء أو العنف، وأن يحظر كذلك نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية أو التحريض على التمييز العنصري، وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال.

The Committee recommends that the State party revise its Criminal Code in order to introduce and implement a specific provision in full compliance with article 4 of the Convention that prohibits dissemination of ideas based on racial superiority or hatred, incitement of racial hatred and discrimination, and prohibition of organizations which promote and incite racial discrimination.

He recalls that any advocacy of national, racial or religious hatred which constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.

For this reason, application of the principle of expediency to the " dissemination of ideas based on racial superiority or hatred " does not contradict General Recommendation 15.

1. To declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
1- اعتبار كل نشر للأفكار القائمة على التفوق العنصري أو الكراهية العنصرية، وكل تحريض على التمييز العنصري وكل عمل من أعمال العنف أو تحريض على هذه الأعمال يرتكب ضد أي عرق أو أية جماعة من لون أو أصل إثني آخر، وكذلك كل مساعدة للنشاطات العنصرية، بما في ذلك تمويلها، جريمة يعاقب عليها القانون؛

(c) To declare as an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(ج) اعتبار كل نشر للأفكار القائمة على التفوق العرقي أو الكراهية العنصرية، وكل تحريض على التمييز العنصري، وكل عمل من أعمال العنف أو التحريض على مثل هذه الأعمال يرتكب ضد أي عرق أو أية جماعة من لون أو أصل عرقي آخر ، وكذلك توفير أي مساعدة لأنشطة عنصرية، بما في ذلك تمويلها، جرائم يعاقب عليها القانون؛

(a) Declaring an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts, against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(أ) اعتبار كل نشر للأفكار القائمة على التفوق العنصري أو الكراهية العنصرية وكل تحريض على التمييز العنصري وكل عمل من أعمال العنف أو تحريض على هذه الأعمال يرتكب ضد أي عرق أو أية جماعة من لون أو أصل عرقي آخر، وكذلك كل مساعدة للنشاطات العنصرية، بما في ذلك تمويلها، جريمة يعاقب عليها القانون؛

On the merits, the Committee qualified Mr. Sarrazin's statements as impugned speech under article 4 of the Convention and observed that, while acknowledging the importance of freedom of expression, it considered that the statements amounted to dissemination of ideas based on racial superiority or hatred and contained elements of incitement to racial discrimination.

Sanctions against the dissemination of ideas based on racial superiority or hatred and incitement to racial discrimination would be applied insofar as they are compatible with the rights to freedom of assembly, association and expression.
وتطبق العقوبات على ترويج الأفكار القائمة على التفوق العرقي أو الكراهية والتحريض على التمييز العنصري في حدود التوافق مع حقوق حرية التجمع وتكوين الجمعيات والتعبير.

418. Concern was expressed that national legislation did not fully meet the requirements of article 4 of the Convention, as the relevant provisions of the Penal Code, in particular its articles 454 and 455, neither penalized the dissemination of ideas based on racial superiority or hatred, in the broadest sense, nor did they prohibit organizations or propaganda activities that promoted and incited racial discrimination.
٤١٨ - وأعرب اﻷعضاء عن قلقهم لعدم وفاء التشريعات الوطنية تماما بمتطلبات المادة ٤ من الاتفاقية، حيث أن اﻷحكام ذات الصلة من القانون الجنائي، وخاصة المادتان ٤٥٤ و ٤٥٥، لا تعاقب على بث اﻷفكار القائمة على التفوق العنصري أو الكراهية العنصرية، بأوسع معانيهما، ولا تحظر المنظمات أو اﻷنشطة الدعائية التي تشجع التمييز العنصري وتحرض عليه.

It also recommended revising the Penal Code in order to criminalize conduct and activities such as propaganda and dissemination of ideas based on racial superiority.
وأوصت أيضاً بتنقيح قانون العقوبات لإضفاء طابع الجريمة على سلوك وأنشطة مثل الدعاية ونشر الأفكار القائمة على التفوق العرقي(48).

11. Reaffirms that any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law, as well as the dissemination of ideas based on racial superiority and hatred and acts of violence and incitement to such acts, and that these prohibitions are consistent with freedom of opinion and expression;
11- يؤكد من جديد وجوب أن يحظر القانون أي دعوة إلى الكراهية القومية أو العرقية أو الدينية تشكل تحريضاً على التمييز أو العداوة أو العنف، فضلاً عن نشر أي أفكار تقوم على التفوق العرقي أو الكراهية العرقية وأفعال العنف والتحريض على ارتكاب هذه الأفعال، وأن هذا الخطر يتسق مع حرية الرأي والتعبير؛
