Although the sentence has not yet become enforceable, it should be pointed out that the mere application of the norm in question constitutes a breach of article 4.2 of the American Convention on Human Rights.

Accordingly, the Court finds that a textual interpretation of the reservation entered by Barbados at the time of ratification of the American Convention clearly indicates that this reservation was not intended to exclude from the jurisdiction of this Court neither the mandatory nature of the death penalty nor the particular form of execution by hanging.

In that connection, it is worth recalling that the provisions of the American Convention on Human Rights are very clear: article 7, paragraph 4, states that " anyone who is detained shall be informed of the reasons for his detention and shall be promptly notified of the charge or charges against him " .
ويذكر في هذا الصدد، من ناحية، بالأحكام الصريحة جدا المنصوص عليها في الاتفاقية الأمريكية لحقوق الإنسان التي تنص في الفقرة 4 من مادتها 7 على ما يلي: ' ' 4 - يخبر كل شخص اعتقل أو احتجز بأسباب اعتقاله ويشعر، في أقرب الآجال، بالتهمة أو التهم الموجهة إليه``.
