٢ - متى فرضت دولة ما قيدا على حق من الحقوق المدرجة في المادة ٥ من الاتفاقية التي تنطبق في ظاهر اﻷمر على كل شخص داخل ولايتها، وجب عليها أن تكفل ألا يكون القيد يوفي الغرض ولا في النتيجة، منافيا للمادة ١ من الاتفاقية باعتبارها جزءا لا يتجزأ من المعايير الدولية لحقوق اﻹنسان.

2. 9. The Committee has identified articles 2, 3, 6 and 12 of the Convention as general principles (see general comment No. 5 (2003) on the general measures of implementation of the Convention).

25. The purpose of reservations was to allow as many countries as possible to become parties to international treaties at the earliest opportunity, while providing flexibility in their compliance with the obligations of the Convention as required by their particular circumstances.
25 - وأوضح أن الغرض من التحفظات هو إفساح المجال لأكبر عدد ممكن من البلدان للانضمام أطرافا إلى المعاهدات الدولية في أول فرصة ممكنة، مع توفير المرونة في تقيدها بالالتزامات التي تقررها الاتفاقية حسب مقتضى ظروف كل بلد منها.
