Any warden or guard of a prison, a disciplinary institution or a correctional facility and any officer acting in that function who admits a person to a facility without a court order or judgement or who keeps a person therein after the extinction of the sentence shall be liable to a penalty of from one to three years' imprisonment.
إن مديري وحراس السجون أو المعاهد التأديبية أو الإصلاحيات وكل من اضطلع بصلاحياتهم من الموظفين إذا قبلوا شخصاً دون مذكرة قضائية أو قرار قضائي أو اسـتبقوه إلى أبعد مـن الأجل المحدد يعاقبون بالحبس من سنة إلى ثلاث سنوات. نصت المادة 359 من قانون العقوبات:

Any person who contravenes this action shall be liable to imprisonment with labor for a term not exceeding two years or to a fine not exceeding one million yen.
وأي شخص يخالف هذا الإجراء يكون عرضة للسجن مع الأشغال لمدة لا تتجاوز عامين أو يكون عرضة لدفع غرامة لا تتجاوز مليون ين.

(3) If in the commission of a crime referred to in Paragraph 1 of this Article the offender has committed intentional manslaughter, the offender shall be liable to imprisonment for a minimum term of ten years or to imprisonment of thirty years. "
(3) إذا اقترف الجاني، أثناء ارتكابه لجريمة مشار إليها في الفقرة 1 من هذه المادة، جريمة قتل عمد؛ فإنه يُعاقَب بالسجن لمدة لا تقل عن عشر سنوات أو لمدة تصل إلى ثلاثين سنة " .

115. Article 159 of the Kuwaiti Penal Code illustrates the extent of the State’s concern for children from the time of their birth. In fact, that article stipulates that any woman who deliberately kills her newborn child in order to avoid shame shall be liable to a penalty of up to five years’ imprisonment and/or a fine of up to 5,000 rupees.
٥١١- ويتضح من المادة ٩٥١ من قانون الجزاء الكويتي مدى اهتمام الدولة باﻷطفال منذ ولادتهم فقد جاء في المادة المذكورة أن كل امرأة تعمدت قتل وليدها فور ولادته، دفعا للعار تعاقب بالحبس مدة لا تتجاوز خمس سنوات وبغرامة لا تتجاوز خمسة آلاف روبية أو بإحدى هاتين العقوبتين.
