It was suggested that a State or an international organization should not be able to formulate an interpretative declaration in respect of a treaty or certain of its provisions in the context of a dispute-settlement process involving the interpretation of the treaty or the provisions in question.
45 - واقتُرح ألا تكون للدولة أو المنظمة الدولية القدرة على إصدار إعلان تفسيري فيما يتعلق بأي معاهدة أو بعض من أحكامها في سياق عملية تسوية نزاع تنطوي على تفسير المعاهدة أو الأحكام المعنية.

152. In approving an interpretative declaration, the author expresses agreement with the interpretation proposed and, in so doing, conveys its own point of view regarding the interpretation of the treaty or of some of its provisions.
152 - بالموافقة على إعلان تفسيري، يعرب صاحب الموافقة عن اتفاقه مع التفسير المقترح، ومن ثم يقدم وجهة نظره إزاء تفسير المعاهدة أو بعض أحكامها.

Article 31 (3) (a) of the Vienna Convention provides that: " 3. There shall be taken into account, together with the context: (a) any subsequent agreement between the parties regarding the interpretation of the treaty or the application of its provisions.
وتنص المادة 31 (3) (أ) من اتفاقية فيينا على ما يلي: " 3 - يؤخذ في الاعتبار، إلى جانب سياق المعاهدة، ما يلي: (أ) أي اتفاق لاحق بين الأطراف بشأن تفسير المعاهدة أو سريان نصوصها " ().

In addition, Article 31(3) (a) provides that " any subsequent agreement between the parties regarding the interpretation of the treaty or the application of its provisions " shall be taken into account, together with the context for the purpose of the interpretation of the treaty.

But it would seem clear on principle that a unilateral document cannot be regarded as part of the " context " for the purpose of interpreting a treaty, unless its relevance for the interpretation of the treaty or for determining the conditions of the particular State's acceptance of the treaty is acquiesced in by the other parties.
لكنه يبدو واضحاً، لأسباب مبدئية، أنه من غير الممكن اعتبار وثيقة انفرادية جزءاً من " سياق " تفسير المعاهدة، ما لم تعترف الأطراف الأخرى بضرورة أن تؤخذ تلك الوثيقة في الاعتبار في تفسير المعاهدة أو في تحديد الشروط التي قبل الطرف المعني المعاهدة بموجبها.
